Great news re: tree saving injunction
The Judicial Review applicants are appealing Justice Gwyn’s unfavourable decision. However, Tūpuna Maunga Authority refused to give an undertaking that Ōwairaka’s trees would not be felled or otherwise harmed before the appeal decision was delivered. So they applied for an injunction in the Auckland High Court. The presiding judge delivered her decision today, after having reserved her decision for a week.
It’s great news - Ōwairaka's trees are safe until the appeal decision is delivered. However, this does not guarantee that trees on other maunga are also safe.
The appeal is being heard in mid July in the Court of Appeal, in Wellington. Apparently the TMA is agitating to have the hearing date brought forward, so it is possible that the hearing date may change. Who knows when the decision will be delivered - hopefully not Xmas Eve!
Ōwairaka's trees may be safe for now but they are not out of the woods (bad pun intended). What happens here will influence the fates of thousands of other trees on Auckland's maunga, so please continue to support our tree-saving efforts by helping on the roster and donating to the cause. Thanks
